Augustus F. Arbitration is defined as the submission of a dispute to an unbiased third person, the "arbitrator," designated by the parties to a controversy, who agree in advance to comply with the decision issued by that third person, after a hearing at which all parties have an opportunity to be heard.

Mediation is a process in which a trained neutral person, a "mediator," helps people in a dispute to communicate with one another, to understand each other, and if possible, to reach agreements that satisfy everyone's needs.

The difference between the two processes is very important: in the arbitration process, the disputing parties agree to abide by the decision of the third party who makes the decision and dictates the terms of an agreement. In Mediation, the neutral person helps the parties reach an agreement but does not himself suggest or declare what that agreement is, does not make the decision, provide any legal advice, or recommend the terms of an agreement.

These days, mediation and arbitration are well-established and widely used means to end disputes, being among several kinds of alternative methods of dispute resolution that have become popular ways of resolving disagreements out of court, saving time and money.
